Welcome to ealiving! These Terms and Conditions ("Terms") govern your use of our website and the purchase of our home staging services. By accessing or using our website, you agree to be bound by these Terms. Throughout these Terms, "we" and "us" refer to ealiving, and "you" refers to the customer.

Return Guidelines

Ordering, Sale & Service Agreement

  • All orders placed through our website constitute a legal contract between you and ealiving for the supply of items sold and/ or the provision of home staging services.
  • We aim to provide high-quality home staging services tailored to your needs and preferences.
  • We will commence staging your property once all necessary information and payments have been received.
  • We provide our products and services within Australia, unless otherwise agreed upon.
  • You must be at least eighteen (18) years old to place orders with ealiving. By accepting these Terms, you confirm that you are over the age of eighteen (18). If any transactions are made by a minor, we reserve the right to seek compensation from the parents or guardians for any losses incurred.
  • All products and services remain the property of ealiving until fully paid for.
  • Please note that our products and staging services may vary in outcome and may not exactly replicate the reference images provided.
  • We guarantee professional and courteous service throughout the staging process.
  • Our team will handle your property and belongings with care and respect.
  • We will strive to create an aesthetically pleasing and marketable environment that enhances your property's appeal to potential buyers.
  • We stand behind the quality of our staging services. If you encounter any issues, please contact us promptly, and we will work to resolve them to your satisfaction.

Placing Your Orders

  • Prices listed on our website include Goods and Services Tax (GST), unless stated otherwise.
  • We reserve the right to change prices for products and services displayed on our website without notice.
  • Orders will not be processed until payment is received in full. We reserve the right to reject any requests and orders.
  • Prices for our home staging services are provided upon request and may vary based on factors such as property size and location.
  • Payment terms for our home staging service will be outlined in our service agreement and must be adhered to for the commencement of staging services.
  • We reserve the right to adjust our home staging prices for our services without prior notice, but any changes will not affect agreed-upon contracts.

Payment Methods and Processing

  • We accept Direct Deposit, Cheque/Money Order, Major Credit Cards, and Paypal. A 3% surcharge will be applied to American Express Credit Card and Paypal payments.
  • We will commence processing your order once we receive all the necessary information.
  • Orders placed on weekends or public holidays will begin payment processing on the next business day.
  • Additional identification may be required for credit cards issued outside of Australia or for ordering amounts above a certain threshold.
  • While we employ the latest in Secure Sockets Layer (SSL) technology for secure transactions, we are not responsible for any damages or losses suffered by customers due to fraud or unauthorised use of credit cards.

Delivery Processing

  • Delivery time for items purchased through our website usually takes up to 8 to 12 weeks from the date of payment received, but it may vary.
  • We will deliver your items to the address provided on your Order Confirmation, unless otherwise agreed upon.
  • If the delivery address is unattended, our Courier will leave the product for you to pick up at the nearest depot or leave in a safe location at your residence.
  • While we make reasonable efforts to deliver your items within the estimated delivery time, we cannot guarantee precise delivery within the expected timeframe.

Home Staging Processing

  • The delivery time of home staging services usually takes up to 1 to 5 weeks from the date of payment received, but it may vary.
  • We will provide our staging services at the location specified by you, unless otherwise agreed upon.
  • If access to the property is unavailable at the scheduled time, our team will reschedule the service for a mutually agreed-upon date and time.
  • While we make reasonable efforts to provide our services within the estimated timeframe, we cannot guarantee precise delivery within the expected schedule.

Product Warranty Guidelines

Our commitment to our product quality is backed by a 5-year warranty to ensure your satisfaction. Please review the terms and conditions below:

Coverage:

  1. The warranty covers defects in materials and workmanship for a period of 5 years from the date of purchase.
  2. Coverage includes repair or replacement of defective parts or products.

Exclusions:

  1. Damages resulting from misuse, accidents, or unauthorised modifications.
  2. Normal wear and tear, including but not limited to scratches, dents, and stains.
  3. Damage caused by improper assembly, installation, or maintenance.

Claim Process:

  2. Provide proof of purchase, a detailed description of the issue, and accompanying images.

Resolution:

  1. We will assess the claim and determine if the issue is covered under the warranty.
  2. If covered, we will either repair or replace the defective part or product.

Shipping Costs:

  1. The customer is responsible for shipping costs related to warranty claims.
  2. ealiving will cover return shipping costs for repaired or replaced items.

Conditions:

  1. The warranty is non-transferable and applies only to the original purchaser.
  2. ealiving reserves the right to void the warranty if the product has been modified or misused.

By purchasing our products, you agree to these terms and conditions. We appreciate your trust in ealiving.

Home Staging Cancellation & Refund Policy 

  • Once staging services have commenced, cancellations may be subject to fees outlined in our service agreement.
  • Refunds may be provided in accordance with Australian consumer law and our service agreement terms.

Return, Replace, Refund of Goods

Damaged or Defective Items

  • If you receive a damaged or defective furniture piece, or you discover the item to be broken when first taken out from its packaging please contact our customer service team immediately.
  • We will work with you to resolve the issue promptly, whether through a replacement, repair, or refund, depending on the circumstances.
  • You must notify us within 3 working days of receiving the item and return the goods in their original condition within this timeframe to be eligible for a full replacement or refund.

General Returns and Exchanges

  • If you are not satisfied with your purchase for any reason, you may request a refund or exchange within 14 days of receiving the item, provided it is in its original condition and packaging.
  • Please contact our customer service team to initiate the return process.
  • No refunds, returns or exchanges are offered if it is made after 14 days of receiving the item.
  • All return must be pre-approved, we do not accept unauthorised return or COD. It is the customer’s responsibility for return shipping charges of the returned goods. It is also your responsibility to ensure the returned goods arrive safely back to us in its original condition. We recommend that the items are properly packed and insured.
  • If customers change their minds and refund will only be issued if customer agree to pay 30% restock fee of the original purchase price. All freights and postage are not refundable.
  • Products sold during discount or sale periods are sold "as is" and may not be exchanged or returned.
  • Return shipping costs are the responsibility of the customer, except in cases where the item received was defective or incorrect.
  • Once we receive the returned item and verify its condition, we will process the refund or exchange within 7 working days. 

Shipping Costs and Misrepresentation

  • If the condition of the item was misrepresented by the customer, the customer may be required to pay all shipping costs.
  • No refunds, credit, or replacements will be provided if the item has been tampered with or used for any profit-generating activities.
  • We will replace your major defect/incorrect item upon receiving it back from you. If a replacement is not possible, a full refund will be issued.
  • Refunds will be issued using the same method as the original payment.

Accuracy and Content

  • ealiving takes all reasonable precautions to ensure the accuracy of the information presented on our website. However, we do not guarantee that the content is error-free or complete.
  • All cares have been taken in the preparation of all materials, but if errors and omissions are unintentional. All information provided on this website is subject to update without notice. Photos and graphics are for presentation and illustration purposes, actual items may slightly vary.
  • We reserve the right to modify, update, or terminate operation of access for any content on our website without prior notice.

Disclaimer

  • ealiving shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to or use of our website or the purchase of our products and enlisting of our services.
  • We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data, or for any indirect or consequential loss or damage of any kind, howsoever arising and whether caused by tort, breach of contract, or otherwise.
  • Photos and graphics are for presentation and illustration purpose, actual items may slight varies.
  • Our website may contain links to third-party websites for your convenience. However, we do not endorse or take responsibility for the content, privacy policies, or practices of these websites.

Indemnification and Jurisdiction

  • By using our website, you agree to indemnify and hold ealiving and its employees harmless from any claims, damages, losses, or expenses arising out of your use of our website or any violation of these Terms.

Governing Law and Jurisdiction

  • These Terms and Conditions, as well as any disputes arising from these Terms or your use of our website, shall be governed by and construed in accordance with the laws of Australia. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Sydney, Australia.
  • Please note that these Terms and Conditions are specific to ealiving, which is based in Sydney, Australia. They do not replace any terms, conditions, and warranties implied by federal and state law of New South Wales.
